Introduction
At Inventoryflow, Inc. we are committed to protecting your privacy. This Privacy Policy covers how InventoryFlow collects, receives, uses, retains, and discloses Personal Information through our website and platform.
Inventoryflow, Inc. (“InventoryFlow”, “us”, “we”, or “our”) operates the website https://www.inventoryflow.com (the “Site”), our software platform, our managed services, and the InventoryFlow-hosted ecommerce infrastructure we provide to our customers (together with the Site, the “Services”). InventoryFlow provides business-to-business software and managed services to powersports dealers and other ecommerce merchants. This Privacy Policy covers all Personal Information collected by InventoryFlow through the Services.
Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. This Privacy Policy describes how we collect, use, disclose, and otherwise process Personal Information. Where applicable law requires consent for a particular activity, we will request that consent separately. We will review this policy regularly, and we may update it from time to time. This Privacy Policy is incorporated into and subject to our Terms of Service.
This Privacy Policy is written for our own business activities. When we process information about the end consumers of our dealer and merchant customers, we generally do so on that customer’s behalf and under that customer’s instructions; Section 2.9 explains this important distinction. Our Services are primarily offered to business customers in the United States and Canada. Personal Information may be processed in the United States and other jurisdictions where InventoryFlow and its Service Providers operate. The Services are not directed to individuals in the European Economic Area, the United Kingdom, or Switzerland, and they are not directed to children. For residents of California and other U.S. states, and for residents of Canada, we have prepared supplemental statements in Sections 14 and 15.
1. When We Collect Personal Information. You may browse the Site without directly submitting Personal Information to us. However, we and our providers may automatically collect Usage Data, online identifiers, and information through cookies and similar technologies as described below. To register for or use the platform, you will be required to provide certain Personal Information about yourself and your organization. Each time you log in, we may request Personal Information and collect Usage Data. We also receive Dealer Business Data and Consumer Data through the systems and integrations that a customer connects or authorizes us to access.
2. Definitions.
2.1 Personal Information. Personal Information means information that identifies, relates to, or could reasonably be linked with a particular individual.
2.2 Usage Data. Usage Data (also referred to as Navigational Information) is data collected automatically, generated by use of the Services or from the Services’ infrastructure itself (for example, the duration of a page visit).
2.3 Cookies. Cookies are small pieces of data stored on your device (computer or mobile device).
2.4 Data Controller. Data Controller means the person or entity that, alone or jointly with others, determines the purposes and means of processing Personal Information. Except as described in Section 2.9, we are the Data Controller of the Personal Information covered by this Privacy Policy. 2.5 Data Processor (or Service Provider). Data Processor (or Service Provider) means any natural or legal person or entity that processes Personal Information on behalf of the Data Controller. We may use various Service Providers in order to process data more effectively, and we may act as a Service Provider to our customers as described in Section 2.9.
2.6 Data Subject. Data Subject is any identified or identifiable individual who is the provider or subject of Personal Information.
2.7 Customer Data. Customer Data means information and content provided by or on behalf of a customer, and includes:
- Dealer Business Data — product and parts information, OEM and distributor information, inventory and availability, pricing and MAP information, vehicle-fitment data, product photographs, listings and listing performance, sales and transaction analytics, and DMS, ERP, marketplace, supplier, and catalog data; and
- Consumer Data — information relating to a customer’s end consumers, which may include names, email addresses, telephone numbers, shipping and billing addresses, order and purchase history, communications, product interests, and storefront or marketplace activity.
Different rules apply to these two categories throughout this Privacy Policy: we hold broad rights in Dealer Business Data, while Consumer Data is used only as described in Sections 5 and 6.
2.8 Outputs; Catalogs; Aggregated Data. Outputs are AI- or machine-generated materials produced by the Services (such as product descriptions, listing copy, optimized titles, structured listing data, enriched metadata, and assembled fitment information). Catalogs are consolidated product catalogs, normalized datasets, fitment databases, and similar compilations we create. Aggregated Data is data derived from Customer Data, Outputs, or use of the Services that has been deidentified or aggregated so that it does not reasonably identify a customer or an individual. InventoryFlow takes reasonable measures to maintain deidentified information in deidentified form and does not attempt to reidentify it, except solely to test whether its deidentification processes remain effective, and contractually requires recipients of deidentified information to comply with equivalent restrictions.
2.9 Our Two Roles. We process Personal Information in two capacities. For information about Site visitors, prospective customers, customer administrators and authorized users, billing and business contacts, and people who communicate with us directly, we act as a Data Controller and this Privacy Policy governs that processing. For Consumer Data that we process in providing the Services to a dealer or merchant, we act as a Data Processor / Service Provider on that customer’s behalf: the customer determines why and how the information is processed; a consumer who wishes to exercise privacy rights should normally direct the request to the relevant dealer or merchant, whose own privacy notice also applies; and the governing customer agreement controls. When InventoryFlow acts as a Data Processor or Service Provider, it processes Consumer Data only for the business purposes specified in the applicable Customer Agreement and does not sell or share that Consumer Data for cross-context behavioral advertising. We will assist our customer in responding to consumer requests as required by our agreements and applicable law.
3. Information Collection and Use. We collect several different types of information for various purposes to provide and improve the Services.
Sources of Personal Information. We obtain Personal Information from: the individual; the customer’s administrators and personnel; dealers and merchants; DMS, ERP, and ecommerce systems that a customer connects; marketplaces; OEMs, distributors, and suppliers; analytics and advertising providers; and publicly available business sources.
4. Types of Data Collected.
4.1 Personal Information. The specific types of Personal Information we collect depend on the Services used and the information you choose to provide. The types of information we collect directly from you or our customers include, without limitation:
- Names, business email addresses, telephone numbers, job titles, and usernames for customer administrators and authorized users;
- Business identity and contact information, including company name and business, billing, and technical contacts;
- Log-in credentials, if you create an account;
- Billing information; payment-card numbers are processed by our third-party payment processor, Stripe, and we do not receive or store raw payment-card numbers;
- Communications, support tickets, demo requests, sales inquiries, and other correspondence you send to us;
- Dealer Business Data provided by or on behalf of a customer;
- Consumer Data, which we process on a customer’s behalf as described in Section 2.9; and
- Credentials, API keys, access tokens, and other third-party-system identifiers that a customer authorizes us to use, which we treat as confidential.
We may use your Personal Information to contact you with newsletters, marketing, or promotional materials that may be of interest to you. You may opt out of these communications by following the unsubscribe link in any marketing email we send.
4.2 Usage Data. We may collect information about how the Site and platform are accessed and used. This Usage Data may include your Internet Protocol (IP) address, approximate location derived from IP address, browser type and version, the pages you visit, the time and date of your visit, time spent on pages, unique device identifiers, and other diagnostic, log, security, and performance data.
4.3 Tracking Cookies Data. We use cookies and similar tracking technologies to track activity on the Site and hold certain information. We use both session cookies (which expire when you close your browser) and persistent cookies (which remain until deleted), for strictly necessary, preferences and functionality, analytics, and advertising purposes. You can set your browser to refuse cookies, but some parts of the Services may not function properly. Third parties may process information collected through their technologies in accordance with their own privacy policies; this Privacy Policy describes InventoryFlow’s decision to deploy those technologies and disclose information to those providers, but does not govern the providers’ independent privacy practices.
4.4 Web Beacons. Web beacons are electronic images that may be used on our Site or in our emails to deliver cookies, count visits, understand usage and campaign effectiveness, and tell whether an email has been opened and acted upon.
4.5 Analytics. We use analytics technologies and providers to help us understand how the Site and platform are used so we can measure and improve performance.
4.6 Advertising and Retargeting. We use third-party advertising technologies (for example, from advertising and social-media platforms) to market InventoryFlow’s Services, including to show you InventoryFlow ads on other sites and to measure their effectiveness. Use of these technologies may constitute “sharing” or a “sale” of Personal Information under certain U.S. state privacy laws; see Section 7.5 and Section 14.
4.7 Do Not Track and Global Privacy Control. Because there is no common industry standard for “Do Not Track,” we do not respond to browser-based “Do Not Track” signals. However, we honor the Global Privacy Control (GPC) as an opt-out of “sale”/“sharing” for the browser on which it is enabled, as described in Section 14.
4.8 Sensitive Information. We do not intentionally collect government identification numbers, precise geolocation, biometric information, health information, or similar categories of highly sensitive Personal Information. We may, however, process account login information, passwords, API keys, access tokens, and other credentials necessary to provide and secure the Services. We use such information only for authentication, integration, security, and related operational purposes.
4.9 Information Generated Through the Services. We generate information through operation of the Services, including Outputs, Catalogs, analytics and reporting, and Aggregated Data.
5. Use of Personal Information. InventoryFlow uses or may use the information it collects for various purposes, including:
- To provide, operate, host, maintain, and secure the Services;
- To authenticate users, provision accounts, and manage access;
- To connect to the third-party systems a customer authorizes us to access, and to create and manage listings;
- To process ecommerce and marketplace workflows, and to communicate with marketplaces and, on a customer’s behalf, with that customer’s consumers in connection with orders;
- To respond to inquiries, demo and sales requests, and support tickets;
- To bill for the Services and collect amounts owed;
- To monitor performance and to detect, prevent, investigate, and address fraud, misuse, security incidents, and technical problems;
- To debug and improve the Services and to develop new integrations, Catalogs, Outputs, analytics, features, and products;
- To develop, evaluate, and improve AI and machine-learning models, as described in Section 6;
- To create and commercialize Aggregated Data;
- To market InventoryFlow’s Services to business customers and prospects; and
- To enforce our agreements, exercise and protect our legal rights, and comply with law.
Under our Master Services Agreement, customers retain ownership of their Customer Data. Customers grant us broad, surviving licenses to use, structure, compile, enrich, create derivative works from, distribute, license, and commercialize Dealer Business Data. Consumer Data may be used only to provide, secure, support, and improve the Services for the applicable customer, to comply with law, and to create deidentified or Aggregated Data. Any Personal Information contained within Dealer Business Data is handled under the Consumer Data rules for privacy purposes. We do not sell or license raw, identifiable Consumer Data to third parties. This Privacy Policy does not grant us rights broader than, and is qualified by, the applicable Master Services Agreement.
6. AI, Automated Processing, and Model Training. The Services use artificial-intelligence and machine-learning systems, including to generate Outputs. InventoryFlow does not use identifiable Consumer Data to train general-purpose or foundation models. InventoryFlow may use Dealer Business Data, Outputs, Usage Data, and deidentified or Aggregated Data to develop, evaluate, and improve the Services, subject to the applicable Customer Agreement and third-party restrictions. Before Consumer Data or other Personal Information is used for product analytics, benchmarking, model development, or purposes independent of providing the Services to the applicable customer, InventoryFlow will deidentify or aggregate the information so that it cannot reasonably identify the individual. We instruct third-party AI providers not to use Customer Data to train or improve their own general-purpose models, and we do not authorize such use. Following termination, InventoryFlow may retain and use deidentified or Aggregated Data and model improvements that do not identify the customer or any individual; InventoryFlow will not retain identifiable Consumer Data for ongoing model training except as required by law or expressly agreed in writing. Models, weights, parameters, and improvements derived from InventoryFlow’s development are InventoryFlow’s property. Outputs may be inaccurate, incomplete, outdated, or fabricated, and customers are responsible for reviewing Outputs before publishing or relying on them.
7. Disclosure of Personal Information.
7.1 Disclosures. Regardless of any choices you make regarding your information, we may disclose information if we believe in good faith that disclosure is necessary to (a) comply with applicable law or to respond to subpoenas, warrants, or legal process; or (b) protect or defend the rights, property, or safety of InventoryFlow, users of the Services, or any other party.
7.2 Affiliates and Business Transfers. We may share information with any corporate affiliate (an entity that controls, is controlled by, or is under common control with InventoryFlow), if any, in which case we will require the affiliate to honor this Privacy Policy. We may also share information in connection with a financing, merger, acquisition, reorganization, sale of assets, or similar transaction, in which case the recipient will assume the rights and obligations described in this Privacy Policy or a successor policy.
7.3 Service Providers and Third Parties. We may share information with Service Providers and third parties that support the Services, including our hosting and cloud-infrastructure provider (Amazon Web Services (AWS)); analytics, monitoring, communications, customer-support, and security vendors; our billing and payment provider (Stripe); AI and machine-learning model providers; and marketplaces, DMS, ERP, OEM, distributor, supplier, catalog, and ecommerce providers as directed or authorized by the customer. We may also share information with professional advisers and with other parties at the direction of, or with the authorization of, the relevant customer or individual. These parties are permitted to use the information only to perform services for us or the customer, or as otherwise authorized.
7.4 Third-Party Systems and Marketplaces. The Services integrate with third-party systems, marketplaces, and dealer storefronts that we do not control. Those third parties’ own terms and privacy policies govern their handling of information, and this Privacy Policy does not apply to them.
7.5 “Sale” and “Sharing” of Personal Information. To the extent U.S. state privacy laws such as the CCPA apply to InventoryFlow, the following applies. Because we use third-party advertising and retargeting technologies to market our Services (Section 4.6), we may share limited online identifiers (such as cookie IDs, advertising IDs, and IP address) and internet-activity information with advertising partners for cross-context behavioral advertising, which may be considered a “sale” or “sharing” under those laws. We do not disclose customer names, business email addresses, telephone numbers, or billing addresses to advertising partners for that purpose. This activity relates to information we handle as a Data Controller (for example, Site visitors and business contacts). It does not apply to Consumer Data that we process on a dealer’s behalf, which we do not sell or share, and it does not include the sale or license of raw, identifiable Consumer Data. You may opt out as described in Section 14.
7.6 Security of Your Personal Information. InventoryFlow’s primary application infrastructure is hosted on AWS in the United States. Personal Information may also be processed by Service Providers in the United States and other jurisdictions where those providers operate. We use industry-standard, commercially reasonable administrative, technical, and physical safeguards to help protect your information from unauthorized access, use, or disclosure, and InventoryFlow applies encryption in transit and at rest where appropriate to the nature of the system and information. No method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for safeguarding your credentials, API keys, tokens, and accounts, and for the security of the systems you connect to the Services. If InventoryFlow becomes aware of a breach of security safeguards involving Personal Information, it will investigate and respond in accordance with applicable law and the applicable Customer Agreement. Where legally required, InventoryFlow will notify affected customers, individuals, and regulatory authorities. InventoryFlow maintains records of security incidents and privacy breaches as required by applicable law. The applicable Master Services Agreement governs any customer-notification deadline.
7.7 Dealer Storefronts. A dealer storefront may be built, hosted, or supported by InventoryFlow, but the dealer or merchant is the operator and the seller and merchant of record and is responsible for its consumer relationships and transactions. For storefronts InventoryFlow hosts, InventoryFlow provides a standard consumer privacy policy and terms of sale that the dealer adopts and publishes as its own, with the dealer identified as the responsible party. The dealer is responsible for ensuring that the storefront privacy policy accurately reflects the dealer’s practices, applicable law, and the technologies deployed on that storefront; InventoryFlow’s template does not constitute legal advice. Do not assume that InventoryFlow is the merchant or seller merely because it provides or hosts the technology.
8. Your Choices Regarding Your Information.
8.1 Choices. You may indicate a preference to stop receiving marketing communications by following the unsubscribe instructions in any marketing email. Despite your indicated preferences, we may send you emails related to your account, transactions, or notices of updates to our Terms of Service or this Privacy Policy. You can set your browser to refuse cookies or alert you when cookies are being sent, though some parts of the Services may not function properly.
8.2 Accessing and Changing Your Information. You may change certain account information, or request access to or deletion of your information, by contacting us at legal@inventoryflow.com or through your administrator. We may retain information where required by law, reasonably necessary to establish or defend legal claims, maintain security, prevent fraud, complete established backup cycles, or honor suppression and opt-out requests. We may also retain information that has been deidentified in accordance with this Privacy Policy. Export and deletion of Customer Data are governed by our Master Services Agreement.
8.3 Requests Relating to Consumer Data. If your request concerns information we process on behalf of a dealer or merchant (Consumer Data — see Section 2.9), please submit it to the relevant dealer or merchant. InventoryFlow may require the requesting individual to identify the relevant dealer or merchant, and, unless applicable law requires otherwise, InventoryFlow will not independently respond to a Consumer Data request without the customer’s authorization. We will refer such requests to, or assist, the applicable customer as required by our agreements and applicable law.
9. Links to Other Sites. The Site and Services may contain links to sites that are not operated by us. If you click a third-party link, you will be directed to that third party’s site, and we strongly advise you to review the privacy policy of every site you visit. We have no control over, and assume no responsibility for, the content or privacy practices of any third-party site or service.
10. Data Retention and International Processing. We retain Personal Information only for as long as necessary for the purposes set out in this Privacy Policy, and to comply with our legal obligations, resolve disputes, maintain security, prevent fraud, enforce our agreements, and keep routine backups. Retention periods depend on the type of information; for example:
- Customer account records — for the duration of the customer relationship and a limited period thereafter;
- Billing and financial records — as required by tax and accounting obligations;
- Support communications — for a limited period after resolution;
- Security and usage logs — for a limited period for security and operational purposes;
- Marketing information — until you unsubscribe or we no longer need it;
- Consumer Data processed for dealers — generally for the duration of the applicable customer relationship and for a limited period thereafter as required by the Customer Agreement, legal obligations, security requirements, and backup cycles;
- Credentials and tokens — for as long as needed to maintain the relevant integration;
- Backups — until overwritten in the ordinary course; and
- Aggregated and deidentified data — which may be retained indefinitely.
InventoryFlow’s primary application infrastructure is hosted on AWS in the United States. Personal Information may also be processed by InventoryFlow’s personnel and Service Providers in the United States and other jurisdictions where they operate. We do not offer the Services to, or intentionally monitor, individuals in the European Economic Area, the United Kingdom, or Switzerland, and this Privacy Policy does not address the GDPR or UK GDPR.
11. Children’s Privacy. The Services are business services intended for use by businesses and individuals who are at least 18 years old. They are not directed to children, and we do not knowingly collect Personal Information from anyone under 18. If you believe a child has provided us with Personal Information, please contact us and we will take appropriate steps to delete it.
12. Changes to This Privacy Policy. We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated Privacy Policy on this page and updating the “Last Updated” date above, and, where appropriate, by email or a prominent notice on the Site. Changes are effective when posted unless a later date is stated. We will not apply a material change retroactively to Personal Information previously collected where doing so would be incompatible with the purposes originally disclosed, unless we provide additional notice and obtain consent where required by law.
13. Questions, Complaints and Disputes. Please contact us at legal@inventoryflow.com with questions or complaints regarding our privacy practices. Nothing in this Privacy Policy limits any non-waivable right to contact or file a complaint with a privacy, consumer-protection, or other governmental authority. Contractual disputes between InventoryFlow and users who validly accepted the Terms of Service remain subject to the dispute-resolution provisions of those Terms, to the extent permitted by applicable law.
14. Supplemental U.S. State Privacy Statement (California and Other States).
Introduction. To the extent U.S. state privacy laws such as the California Consumer Privacy Act as amended (the “CCPA”) apply to InventoryFlow, this Statement explains rights that residents of California and certain other U.S. states may have. When we use “personal information” in this Statement, we use it as those laws define it. Note that the personal information of our business contacts — including customer administrators and authorized users acting in a business role — has been within the scope of the CCPA since 2023.
14.1 Categories of personal information we collect and whether we “sell” or “share” it. Where we act as a “business” under the CCPA, we collect the following categories of personal information. We collect this information for the business and commercial purposes described in Section 5, obtain it from the sources described in Section 3, and disclose it to the categories of recipients described in Section 7. We have collected and disclosed the following categories of personal information within the last twelve (12) months. For each category we indicate whether it is collected and whether any of it is “sold” or “shared” as those terms are defined under the CCPA:
- A. Identifiers (name, business email, phone, postal address, IP address, cookie and advertising IDs, account identifiers). Collected: yes. Sold/Shared: only limited online identifiers (cookie and advertising IDs, IP address) for cross-context behavioral advertising — not names, business emails, phone numbers, or billing addresses.
- B. California customer-records information (business and billing contact details). Collected: yes. Sold/Shared: no.
- C. Protected classification characteristics (age, race, gender, and similar). Collected: no. Sold/Shared: no.
- D. Commercial information (services purchased or considered; business transaction records). Collected: yes. Sold/Shared: no.
- E. Biometric information. Collected: no. Sold/Shared: no.
- F. Internet or other network activity (browsing and usage on our Site; interactions with our ads and emails). Collected: yes. Sold/Shared: yes (browsing activity, for advertising).
- G. Geolocation data (approximate location from IP only). Collected: approximate only. Sold/Shared: no.
- H. Sensory data. Collected: no. Sold/Shared: no.
- I. Professional or employment information (job title, employer, business role). Collected: yes. Sold/Shared: no.
- J. Non-public education information. Collected: no. Sold/Shared: no.
- K. Inferences (limited inferences for marketing and analytics). Collected: limited. Sold/Shared: no.
- L. Sensitive personal information (account-login information and credentials used to access InventoryFlow or authorized third-party systems). Collected: yes. Sold/Shared: no.
Only limited online identifiers, such as cookie IDs, advertising IDs, and IP addresses, together with related browsing activity, may be shared with advertising partners for cross-context behavioral advertising. We do not disclose customer names, business email addresses, telephone numbers, or billing addresses to advertising partners for that purpose.
We collect limited sensitive personal information consisting of account-login information and credentials used to access InventoryFlow or authorized third-party systems. We use and disclose this information only for authentication, integration, security, and related operational purposes, and not to infer characteristics about an individual.
14.2 Your privacy rights. To the extent these laws apply to InventoryFlow, and subject to their exceptions, thresholds, and verification requirements, you may have the right to: (a) know or access the personal information we hold about you and details about our processing; (b) correct inaccurate personal information; (c) delete personal information; (d) obtain a portable copy of certain information; (e) opt out of “sale,” “sharing,” and targeted advertising; and (f) appeal a denial of your request. We will not discriminate against you for exercising these rights.
To make a request, contact us at legal@inventoryflow.com. We will take steps to verify your identity and may request information reasonably necessary to do so; if we cannot verify your identity, we may request additional information. We will confirm receipt and respond within the time required by applicable law (for California, generally within 45 days, extendable by an additional 45 days with notice). You may use an authorized agent, subject to proof of authorization and, where permitted, verification of your identity. You may opt out of “sale”/“sharing” and targeted advertising by using the “Do Not Sell or Share My Personal Information” link on the Site, by enabling the Global Privacy Control in a supported browser, and/or through our cookie-consent tool.
14.3 Notice at collection. This Statement, together with Sections 3 through 7, serves as our notice at collection for California residents.
15. Supplemental Canadian Privacy Statement.
This Statement applies to individuals whose Personal Information is subject to Canadian private-sector privacy law and is intended to comply with the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and substantially similar provincial privacy laws.
15.1 Access and correction. You may request access to the Personal Information we hold about you and request correction of inaccurate or incomplete information, subject to applicable legal exceptions.
15.2 Consent and withdrawal. Where we rely on your consent to process Personal Information, you may withdraw that consent at any time, subject to legal or contractual restrictions and reasonable notice; withdrawing consent may affect our ability to provide certain Services.
15.3 Cross-border processing. Your Personal Information may be stored or processed in the United States and other jurisdictions where InventoryFlow and its Service Providers operate. As a result, it may be subject to the laws of those jurisdictions and accessible to their courts, law enforcement, and regulatory authorities.
15.4 Commercial electronic messages. Where CASL applies, InventoryFlow sends commercial electronic messages only with express consent, valid implied consent, or another applicable legal basis. Such messages identify InventoryFlow and any person on whose behalf they are sent, provide required contact information, and include a readily usable unsubscribe mechanism. InventoryFlow maintains records reasonably necessary to demonstrate compliance.
15.5 Complaints and contact. You may direct questions, access requests, or complaints to our Privacy Officer, Inventoryflow, Inc., at legal@inventoryflow.com or 981 Mission Street, San Francisco, California 94103. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada or your applicable provincial privacy regulator.
15.6 Consumer Data processed for dealers. Where InventoryFlow processes Consumer Data on behalf of a dealer or merchant, the relevant dealer or merchant is generally responsible for responding to access, correction, and consent-withdrawal requests. InventoryFlow will assist that customer as required by applicable law and contract.
